At El Gaucho Argentinian Steakhouse (“El Gaucho”, “we”, “our”, or “us”), we are committed to protecting your privacy and handling personal data responsibly.

Technical and usage information: your IP address, browser and device information, pages visited, website interactions, and cookie or similar identifiers.
Social Login information: information received through Facebook Login, as explained in Section 5.

We collect information directly from you, through your use of our website, and from service providers where necessary and lawful to provide services you request.

If you provide allergy or other health-related dietary information, we use it to address your request. Health information and certain financial or online behavioural information may constitute sensitive personal data under Vietnamese law. Where we request consent to process sensitive personal data, we will identify its sensitive nature and explain the relevant purpose.

Payment providers process payment information according to the payment method selected. We may receive transaction references, payment status, and information needed to manage orders or refunds.

Where a provider processes personal data independently rather than solely on our behalf, its own privacy notice explains that processing and the rights available to you. This does not remove our responsibilities for personal data we collect or disclose.

Non-essential cookies and similar tracking technologies requiring consent will only be used after you provide the relevant consent. Optional categories will not be enabled on the basis of silence or inactivity.

Sharing is limited to the relevant purpose and information necessary for that purpose. Where consent is required for a disclosure, we obtain it before sharing the data.

Providers processing personal data on our behalf must follow the agreed purposes, instructions, and applicable data protection requirements. Providers acting independently remain responsible for their own processing.

8. Data Retention

We retain personal data only for as long as necessary for the purposes explained in this Policy and any applicable legal retention requirements.

Retention periods depend on the information and its purpose. Account information is retained as necessary to provide and manage your account. Reservation, order, and payment records may need to be retained to fulfil transactions, address complaints, and meet accounting or tax obligations.

Information used for consent-based marketing will no longer be used for that purpose after consent is withdrawn. We may retain a limited record of your preferences where lawfully necessary to respect your choice and demonstrate compliance.

Deleting your profile does not necessarily require deletion of transaction records that we must retain by law. Any retained information will be limited to the relevant lawful purpose.

When information is no longer required, we will securely delete, destroy, or permanently de-identify it as permitted by law. Personal data received through Facebook Login is also subject to Section 12.

9. International Data Transfers

Some of our service providers may process or store personal data outside Vietnam, including when providing hosting, authentication, analytics, or other digital services.

We will only carry out such transfers in accordance with applicable Vietnamese data protection requirements, including relevant safeguards, notices, and any required impact assessments or regulatory filings.

We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse, alteration, disclosure, or destruction.

Access is limited to personnel and service providers who need the information for authorised purposes.

Although we take protective measures, no website, transmission method, or storage system is completely risk-free. A security incident could result in unauthorised access, disclosure, or misuse of information. We will investigate incidents and carry out notifications or other measures required by applicable law.

Please keep your account credentials confidential and contact us if you suspect unauthorised access to your El Gaucho account.

To exercise your rights, use the contact details in Section 14. We may request information reasonably necessary to verify your identity and understand your request.

We will respond and act within the deadlines applicable to the type of request. The procedure and timing for deletion requests are explained in Section 12.

You may stop marketing emails using the unsubscribe option provided or by contacting us. This does not stop necessary communications about existing reservations, orders, or privacy requests.

You may also contact the competent Vietnamese authority responsible for personal data protection if you believe your rights have been violated.

12. Profile & Data Deletion Requests

You may request deletion of personal data associated with your El Gaucho profile or use of our digital services, including personal data received through Facebook Login.

a. Delete Your Profile Directly

We will handle the associated personal data in accordance with the deletion process and retention limits explained below.

If you cannot access your account, cannot use the deletion feature, or would like to request deletion of additional personal data, you can contact us directly. You do not need access to your account to submit a request.

b. Request Deletion by Email or Private Message

Please submit your request through either of these channels:

Email: info.vietnam@elgaucho.asia, preferably with the subject “Data Deletion Request”.
Facebook: send a private message to ElGauchoVietnam.

Please include your full name, the email address associated with your account where applicable, and a brief description of your request. If the request concerns Facebook Login, please mention El Gaucho Social Login.

A particular email subject or wording is not required. If you cannot provide an account email address, explain this so we can help identify the relevant account or information.

Please do not send passwords, full payment card details, or identity documents through public Facebook comments.

c. Verification & Processing

We may request additional information where reasonably necessary to verify your identity, identify the relevant data, and prevent unauthorised deletion.

For valid requests, we will delete the relevant personal data unless a lawful exception requires or permits its retention. Where we cannot delete particular information, we will explain the reason and limit its use to the applicable lawful purpose.

For personal data received through Facebook Login, we will delete the relevant data received from Meta when processing your deletion request, except to the extent retention is required by applicable law.

Where necessary, we will also require relevant processors or other recipients to take the actions required by law.

Deleting an El Gaucho profile does not delete your Facebook account.

d. Response & Completion Times

We will respond within two working days of receiving a deletion request submitted through the procedure above, explaining the process and any information reasonably required.

A valid deletion request will be completed within 20 days, or within 30 days where action by a data processor or another third party is required, in accordance with applicable Vietnamese law.

Where legally permitted and necessary because of the nature or complexity of a request, the processing period may be extended once by no more than 20 additional days. We will explain the reason for the extension and notify you of the expected completion date.

We will confirm when processing is complete or explain any lawful reason why all or part of the request cannot be fulfilled.

These request channels are available to all users of El Gaucho Social Login, including users who can no longer access their El Gaucho account.

13. Changes to This Policy

We may update this Privacy & Cookie Policy to reflect changes in our services, technologies, processing activities, or legal requirements.

Updated versions will be published on our website with a revised “Last Updated” date.

Where required, we will notify you of material changes and obtain consent before introducing new processing that requires it. Publishing an updated policy does not, by itself, constitute your consent.
