It also explains how you can manage your preferences and exercise your rights under the Personal Data Protection Act B.E. 2562 (2019) (“PDPA”) of Thailand.

Technical and usage information: your IP address, browser and device information, pages visited, website interactions, and cookie or similar identifiers.
Social Login information: information received through Facebook Login, as explained in Section 5.

We collect information directly from you, automatically through your use of our website, and from service providers where necessary to provide services you request.

Payment transactions are processed through third-party payment providers. El Gaucho does not store your full payment card details on our servers.

2. How We Use Personal Data

Where information is necessary to process a reservation, fulfil an order, create an account, or meet a legal obligation, we may be unable to provide the relevant service if that information is not supplied.

Where processing is based on your consent, you may withdraw that consent at any time. Withdrawal does not affect the lawfulness of processing carried out before your consent was withdrawn.

We use this information to authenticate you, create or connect your El Gaucho account, and provide the requested login functionality.

You may request deletion of personal data associated with Facebook Login using the options described in Section 12 — Profile & Data Deletion Requests.

Other Third-Party Services

Google, Meta, and other providers may also use cookies or similar technologies and process information under their own privacy policies.

Where a provider processes personal data independently rather than solely on our behalf, its own privacy notice explains that processing and the rights available to you.

Our cookie preference controls allow you to:

Reject non-essential cookies.

Where consent is required, non-essential cookies and similar tracking technologies will only be used after you provide the relevant consent.

You may change or withdraw your choices through Cookie Settings on our website.

Deleting cookies from your browser does not, by itself, delete your El Gaucho profile or personal data already held by us. To request deletion of that data, please follow Section 12.

We do not sell your personal data.

We may share relevant personal data with service providers that help us operate our website, process reservations and transactions, provide delivery or customer support, manage accounts and Social Login, or carry out analytics and marketing activities where permitted.

We may also disclose information to professional advisers, regulators, public authorities, or other recipients where necessary and lawful to meet legal obligations, respond to lawful requests, or establish, exercise, or defend legal claims.

Providers processing personal data on our behalf are required to process it for the agreed purposes and comply with applicable data protection requirements.

We limit the information shared to what is reasonably necessary for the relevant purpose.

8. Data Retention

We retain personal data only for as long as necessary for the purposes described in this Policy and to meet applicable legal, accounting, tax, security, and dispute-resolution requirements.

Retention depends on the type of information, the service provided, whether the information remains necessary, and any applicable legal retention period.

A request to delete your profile does not necessarily require the deletion of transaction records that we must retain by law. Any information retained after a deletion request will be limited to what is necessary for the applicable lawful purpose.

When personal data is no longer required, we will delete it, permanently anonymise it, or otherwise securely dispose of it. Personal data received through Meta is also subject to the specific deletion provisions in Section 12.

9. International Data Transfers

Some of our service providers may process or store personal data outside Thailand.

Where personal data is transferred internationally, we will use a transfer mechanism or exception permitted by applicable Thai data protection law and implement the safeguards required for the transfer.

You may contact us for further information about relevant international transfers and the safeguards applicable to your personal data.

10. Data Security

We take appropriate technical and organisational measures to protect personal data against unauthorised access, loss, misuse, alteration, disclosure, or destruction.

Access is limited to personnel and service providers who need the information for authorised purposes.

No website, transmission method, or storage system can be guaranteed to be completely secure. Please keep your account credentials confidential and contact us if you suspect unauthorised access to your El Gaucho account.

11. Your Privacy Rights

Subject to the conditions and exceptions under applicable law, you may exercise the following rights:

Access: request access to or a copy of personal data we hold about you.
Rectification: request correction of inaccurate or incomplete information.
Erasure: request deletion, destruction, or anonymisation of personal data where applicable.
Restriction: request that we restrict certain processing.
Data portability: request that eligible personal data be provided or transferred in a structured, machine-readable format.
Objection: object to certain processing, including processing for direct marketing.
Withdrawal of consent: withdraw consent previously provided.

You may unsubscribe from marketing emails using the unsubscribe option in the message or by contacting us. Unsubscribing from marketing does not stop necessary communications about existing reservations, orders, or privacy requests.

To exercise your rights, use the contact details in Section 14. We may request information reasonably necessary to verify your identity before acting on a request.

You may also lodge a complaint with the Personal Data Protection Committee of Thailand through the Office of the Personal Data Protection Committee if you believe your personal data has been processed unlawfully.

12. Profile & Data Deletion Requests

You may request deletion of personal data associated with your El Gaucho profile or use of our digital services, including personal data received through Facebook Login.

a. Delete Your Profile Directly

You can use the profile deletion feature within your El Gaucho account and follow the instructions displayed to delete your profile.

Personal data associated with the deleted profile will be handled in accordance with the deletion process and retention limits described below.

If you cannot access your account, cannot use the deletion feature, or would like to request deletion of additional personal data, you can contact us directly.

b. Request Deletion by Email or Private Message

Please submit your request through either of these channels:

Email: info.thailand@elgaucho.asia, preferably with the subject “Data Deletion Request”.
Facebook: send a private message to ElGauchoThailand.

Please include your full name, the email address associated with your account where applicable, and a brief description of your request. If the request concerns Facebook Login, please mention El Gaucho Social Login.

An email subject line or particular wording is not required for us to consider your request.

Please do not send passwords, full payment card details, or identity documents through public Facebook comments.

c. Verification & Processing

We may request additional information where reasonably necessary to verify your identity and prevent unauthorised deletion.

For valid requests, we will delete or permanently anonymise the relevant personal data, except to the extent that retention is required or otherwise permitted under applicable law. Where information must be retained, we will explain the reason and limit its use to the relevant lawful purpose.

For personal data received through Facebook Login, we will delete the relevant data received from Meta when processing your deletion request, except to the extent retention is required by applicable law.

We will act on requests without undue delay and within applicable legal time limits. We will notify you when processing is complete or explain any lawful reason why we cannot fulfil all or part of the request.

These deletion request channels are available to all users of El Gaucho Social Login, including users who can no longer access their El Gaucho account.

13. Changes to This Policy

We may update this Privacy & Cookie Policy to reflect changes in our services, technologies, processing activities, or legal requirements.

Updated versions will be published on our website with a revised “Last Updated” date. Where required, we will notify you of material changes or obtain consent before introducing processing that requires it.
