1. Introduction
Welcome to elgaucho.asia (the “Site”), operated by Gaucho Co., Ltd (“El Gaucho”, “we”, “our”, or “us”). By accessing or using this Site, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully before using any of our services.
These Terms apply to all services offered through this Site, including dine-in reservations, takeaway orders, delivery, online store purchases, catering enquiries, and promotional offers.
General use of our website and digital platforms is governed by our Terms of Service.
If you do not agree to these Terms, please refrain from using the Site.
2. Reservations & Dine-In
2.1 Table Reservations
When making a reservation, please note the following:
- We will hold your reserved table for up to 15 minutes after your scheduled booking time. We cannot guarantee table availability after this period.
- Any cancellations, changes to the number of guests, or late arrival notices must be communicated at least 90 minutes before your reservation time.
- Failure to notify us within this window may result in cancellation of the reservation.
2.2 Private Dining Rooms
Our private dining rooms are available subject to a minimum spend requirement of THB [25,000] per booking. Please contact us directly to confirm availability and arrangements.
Cancellation & Prepayment Policy for Private Dining:
- A prepayment will be required to confirm your reservation; the prepayment amount will be advised at the time of booking based on your party size and event requirements.
- Cancellations made more than 48 hours before the booking date will receive a full prepayment refund.
- Cancellations made within 48 hours of the booking date will forfeit the prepayment.
- No-shows will forfeit the full prepayment.
3. Ordering — Dine-In, Takeaway & Delivery
3.1 General
El Gaucho offers three ordering channels: Dine-In at our restaurants, Takeaway (pick-up), and Delivery to your address. Availability of each channel may vary by location and is subject to change without prior notice.
El Gaucho reserves the right to modify menu items, pricing, and product availability at any time without prior notice. Product images on the Site are for illustration purposes only; actual products may vary.
3.2 Delivery
Delivery orders will be dispatched to the address you provide at checkout. Please ensure your delivery address is accurate and complete. El Gaucho shall not be liable for failed or delayed delivery resulting from an incorrect address provided by the customer.
While we make every effort to fulfil your order within the estimated timeframe, we shall not be held liable for delays caused by circumstances beyond our reasonable control, including traffic, weather conditions, or third-party logistics issues.
A minimum order value of THB 2,000 applies to all delivery orders. For locations open 24 hours (El Gaucho Sukhumvit Soi 20), a minimum order value of THB 5,000 applies for deliveries placed between Midnight and 11:00 AM.
Delivery availability, coverage areas, and fees are subject to change. Please check the Site or contact us for current details.
3.3 Catering & Events
For catering and event enquiries, please contact us directly. Specific terms, pricing, and minimum spend requirements will be confirmed in a separate agreement at the time of booking.
4. Payment
We accept the payment methods listed on the Site at checkout. By placing an order, you confirm that you are authorised to use the selected payment method.
All prices displayed on the Site are exclusive of VAT and applicable taxes, which will be calculated and added at the time of checkout.
Your payment details are encrypted and processed securely. We do not store your full card details on our servers.
Payment authorisation is required at the time of placing your order. Your order is confirmed upon successful payment.
Our liability in connection with any order shall not exceed the total price paid for the relevant items.
5. Returns & Refunds
El Gaucho is committed to delivering premium quality products. We handle refund and replacement requests as follows:
5.1 Eligible Refunds & Replacements
- Incorrect product delivered (item does not match your order)
- Product received in an unsatisfactory condition upon delivery
Eligible claims must be raised within 24 hours of receiving your order. Please contact our team with photographic evidence where possible.
5.2 Non-Eligible Refunds
- Change of mind after order placement
- Incorrect product selected at the time of ordering
- Claims made more than 24 hours after acceptance of the delivery
5.3 How to Raise a Refund Request
To raise a refund or replacement request, please contact our team within 24 hours of receiving your order via email at info.thailand@elgaucho.asia or message us on Facebook at ElGauchoThailand. Please include your order reference number and, where applicable, photographic evidence of the issue.
6. Food Allergies & Special Dietary Requirements
Please inform us of any allergies or dietary restrictions when placing your order online or when dining with us. We will make every reasonable effort to accommodate your requirements; however, we cannot guarantee a completely allergen-free environment. Customers with severe allergies are advised to contact us directly before placing an order.
7. Promotion or Discount
The following general terms apply to all promotional offers unless otherwise stated in the specific promotion’s terms:
- Promotions or discounts are not applicable in combination with any other promotions or discounts.
- Promotions or discounts are not applicable on public holidays or special event days, unless otherwise specified.
- El Gaucho reserves the right to modify, suspend, or terminate any promotion at any time without prior notice.
- Applicable locations for promotions may vary and are subject to change.
- All promotions or discounts are valid until stocks last, unless a fixed end date is stated.
- Product images used in promotional materials are for illustration purposes only.
7.1 All-Time Favorites
Our All-Time Favorites selection is available for Dine-In, Takeaway, and Delivery.
7.2 Super Tuesday
- Applies for Dine-In only. Pickup and Delivery services are not eligible for Super Tuesday.
- Book your table no later than 12:00 PM on the promotion day to avail the offer.
- Walk-in customers are not eligible for this promotion.
- Valid until stocks last.
- Available all day at all locations.
- For locations open 24 hours (El Gaucho Sukhumvit Soi 20), the promotion is available from 11:00 AM to Midnight.
7.3 Butcher Shop Promotion:
- Products are vacuum-sealed and delivered chilled to maintain freshness and food safety.
- Available for online order from website only at
- Free delivery within 10km. Orders outside 10km are delivered via Grab, with delivery fee borne by customer.
- Orders must be received and refrigerated/frozen promptly upon delivery.
- No returns or exchanges once the product has been delivered and accepted, except in cases of product damage or quality issues.
- Applicable locations for this promotion may vary and are subject to change.
- Valid until stocks last
